1. About these terms

1.1 This website at caalanodigital.com.au (the Site) is operated by Caalano Digital Pty Ltd (ABN 31 670 857 397) of 612/7 Maitland Place, Norwest NSW 2153 (Caalano Digital, we, us, our).

1.2 By accessing or using the Site you agree to these Terms of Use. If you do not agree, please do not use the Site.

1.3 These Terms of Use govern your use of the Site only. If you engage us to provide services, a separate Marketing Services Agreement applies, and that agreement prevails over these Terms of Use to the extent of any inconsistency.

1.4 Caalano Systems Pty Ltd (ABN 49 670 857 851) is a related company that operates the Caalano Systems platform. That platform has its own terms at caalanosystems.com.au/terms-conditions.

2. Using the Site

2.1 You may use the Site for lawful purposes and to find out about our services.

2.2 You must not:

• (a) use the Site in a way that breaches any law or infringes anyone's rights;
• (b) attempt to gain unauthorised access to the Site or any system connected to it;
• (c) introduce malicious code, or interfere with the Site's operation or security;
• (d) scrape, harvest, data-mine or systematically extract content from the Site, or use automated means to access it, except for legitimate search engine indexing;
• (e) use content from the Site to train a machine learning or artificial intelligence model without our written consent;
• (f) frame, mirror or reproduce the Site or any substantial part of it; or
• (g) use the Site to send unsolicited commercial messages, or to collect contact details for that purpose.

2.3 We may suspend or withdraw access to the Site, or any part of it, at any time.

3. Enquiries and the information you give us

3.1 When you submit an enquiry, book a call or subscribe through the Site, you give us your name, contact details and whatever else you choose to tell us.

3.2 We handle that information in accordance with our Privacy Policy at caalanodigital.com.au/privacy-policy, which forms part of these Terms of Use.

3.3 Collection notice. We collect this information to respond to your enquiry, to assess whether we can help, and, where you have consented, to send you information about our services. We may store it in our customer relationship management platform, which is hosted in the United States. Our Privacy Policy sets out the countries our service providers are located in, how to access or correct your information, and how to complain.

3.4 We only send marketing communications to people who have consented to receive them. Every marketing message identifies us and contains a working unsubscribe. You can opt out at any time.

3.5 You warrant that the information you give us is accurate, that it is yours to give, and that if you provide someone else's details you have their authority to do so.

4. Our content

4.1 We own, or are licensed to use, all content on the Site, including text, graphics, logos, images, video, audio, case studies, frameworks and software. This is protected by copyright and other laws.

4.2 You may view, download and print content from the Site for your own personal or internal business use only. You must not reproduce, republish, adapt, distribute, sell or commercially exploit it without our written permission.

4.3 "Caalano", "Caalano Digital", "Caalano Systems" and our logos are our trade marks. You must not use them without our written permission.

4.4 If you send us feedback, suggestions or ideas about our services, we may use them without obligation to you.

5. Content you submit

5.1 If the Site allows you to post comments, reviews or other content, you must ensure it is accurate, lawful, not misleading, and not defamatory, discriminatory, obscene or in breach of anyone's rights.

5.2 You grant us a non-exclusive, royalty-free licence to use, reproduce and display that content in connection with operating and promoting the Site. This licence does not extend to any personal information you provide, which is handled only under our Privacy Policy.

5.3 We may remove any content at our discretion.

6. Case studies, results and claims

6.1 The Site contains case studies, client results and performance figures. These describe outcomes achieved by specific clients in specific circumstances. They are examples, not a prediction, promise or guarantee of the results you would achieve.

6.2 Results depend on many factors outside our control, including your market, your offer, your pricing, your sales process, your budget and how quickly you follow up leads.

6.3 Where we publish a client's name, logo or results, we do so with their consent.

7. Third party sites and content

7.1 The Site may link to third party websites. We do not control them, we do not endorse them, and we are not responsible for their content, products or privacy practices.

7.2 Any dealings you have with a third party through a link are between you and them.

8. Availability

8.1 We try to keep the Site available but do not guarantee it will be uninterrupted, secure or error free. It may be unavailable for maintenance or for reasons outside our control.

8.2 We may change, suspend or discontinue any part of the Site at any time without notice.

9. Australian Consumer Law

9.1 Nothing in these Terms of Use excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

9.2 Where our liability can be limited but not excluded, our liability is limited, at our option, to resupplying the relevant service or paying the cost of having it resupplied.

9.3 Clauses 10 and 11 apply only to the extent permitted by law and are subject to this clause 9.

10. Disclaimers

10.1 Subject to clause 9, the Site and its content are provided on an "as is" basis. The content is general information about our services and is not advice, and it does not take account of your particular circumstances.

10.2 Nothing on the Site is legal, medical, clinical, financial or compliance advice. Where the Site discusses privacy law, advertising law or health regulation, it is general commentary and may not be current. You should obtain your own professional advice.

10.3 We do not warrant that the content is accurate, complete or current.

11. Liability

11.1 Subject to clause 9, and to the maximum extent permitted by law, we are not liable for any loss or damage arising from your use of the Site, including indirect or consequential loss, loss of profit, loss of revenue, loss of data or loss of business opportunity.

11.2 Subject to clause 9, our total aggregate liability arising from your use of the Site is limited to $100.

11.3 Nothing in this clause limits our liability for fraud, wilful misconduct, or death or personal injury caused by our negligence.

12. Cookies and tracking

12.1 The Site uses cookies and similar technologies for functionality, analytics and, where you consent, advertising. This currently includes Google Tag Manager, Google Analytics and the Meta pixel.

12.2 You can manage cookies through your browser settings and through the consent controls on the Site. Advertising and analytics cookies do not operate until you have made a choice.

13. Changes to these terms

We may update these Terms of Use. The current version is always at caalanodigital.com.au/terms-and-conditions with the date at the top. Continued use of the Site after a change means you accept it.

14. Governing law

These Terms of Use are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State and the Commonwealth.
